Terms of Service

1. Acceptance of Terms & Eligibility

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Creator", "User", "you") and Fifth Force ("Fifth Force", "we", "us", or "our"), governing your access to and use of HUUMANEXT EMBER ("Ember", "the Service"), including our website (https://ember.huumanext.com/) and the Ember software application.

By accessing or using the Service, you confirm that you are at least 18 years of age (or have reached the age of legal majority in your jurisdiction), possess the legal capacity to enter into these Terms, and agree to be bound by them. If you use the Service on behalf of an entity or organization, you represent that you have the authority to bind that entity to these Terms.

2. Description of the Service

HUUMANEXT EMBER is a Creator Intelligence System. It provides creators with an intelligent companion that learns their voice, reasoning style, and editorial preferences through the Creator Intelligence Loop™, Decision DNA™, and earned autonomy.

Core features include private research note grounding, lexical style profiling, semantic decision diff analysis, draft generation assistance, ApprovalGate publishing controls, verifiable cryptographic Decision Ledger records, and official third-party social platform publishing connectors (such as LinkedIn and X).

3. User Accounts & Security

To access the Ember creator environment, you must authenticate through our supported identity service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify Fifth Force immediately of any unauthorized access to or security breach involving your account. Fifth Force is not liable for any loss or damage arising from your failure to protect your login credentials.

5. AI-Generated Outputs & Creator Editorial Authority

Ember generates assistive drafts, structural outlines, and style suggestions ("Outputs") based on probabilistic AI models grounded in your private notes and Voice DNA.

• Assistive Proposals, Not Final Truth: Outputs are assistive proposals for creator review. They do not constitute verified statements of fact or professional advice.
• Creator Editorial Responsibility: You are solely responsible for reviewing, editing, factual verification, and approving any Output before it is published or distributed. Fifth Force is not responsible for any inaccuracies, omissions, copyright issues, or legal liabilities arising from content you choose to publish.
• Approval Gates & Kill-Switch: By default, Ember operates with human-in-the-loop approval gates. Autonomous publishing is enabled only when you explicitly configure Earned Trust delegation, and you can pause or revoke autonomous publishing at any time via the emergency kill-switch.

6. Third-Party Platform Integrations (X, LinkedIn & Others)

Ember enables direct publishing to connected third-party networks (including X and LinkedIn) strictly through official OAuth 2.0 PKCE integrations and platform APIs:

• Third-Party Terms Govern: Your use of connected third-party platforms is subject to their respective terms, community guidelines, and developer policies (e.g., the X Developer Agreement, X User Agreement, LinkedIn User Agreement). In the event of a conflict regarding your relationship with the third-party network, their terms govern.
• Compliance Responsibility: You are solely responsible for ensuring that content published through Ember complies with the rules, rate limits, and policies of your connected platforms.
• No Liability for Platform Actions: Fifth Force is not liable for account restrictions, suspensions, API deprecations, rate-limit throttles, or distribution changes imposed by third-party platforms.
• Manual Handoff Fallback: For platforms where official publishing APIs are unavailable (e.g., Substack, Medium), Ember provides AI-assisted manual handoff payloads without attempting unofficial browser automation or scraping.

7. Prohibited Uses & Conduct

You agree not to use HUUMANEXT EMBER to:

• Generate, publish, or distribute illegal, defamatory, harassing, hateful, threatening, or sexually explicit content;
• Engage in automated spamming, deceptive engagement farming, or coordinated platform manipulation;
• Violate or infringe the intellectual property, privacy, or publicity rights of any third party;
• Attempt to reverse engineer, decompile, disassemble, or extract source code from the Ember platform;
• Bypass, disable, or tamper with security boundaries, tenant isolation (RLS), approval gates, or rate limits;
• Harvest or scrape data, credentials, or private information from other creators;
• Use the Service to develop or train competing machine learning foundation models or commercial content-scraping bots.

8. Service Availability & Modifications

We strive to provide reliable and continuous operation of HUUMANEXT EMBER. However, the Service is provided on an "as is" and "as available" basis. Fifth Force does not guarantee that the Service will operate uninterrupted, error-free, or without latency.

We reserve the right to modify, enhance, or temporarily suspend features for maintenance, security upgrades, or architectural improvements with reasonable notice where practical.

9. Disclaimers & Limitation of Liability

10. Suspension, Termination & Data Erasure

You may terminate your account at any time by submitting an account deletion request through the Ember application.

Fifth Force may suspend or terminate your access to the Service if you materially breach these Terms, engage in unlawful activities, or pose a security risk to the platform.

Upon verified account termination, your data will be purged and your creator Data Encryption Key (DEK) destroyed in accordance with our cryptographic key-shredding protocol as detailed in our Privacy Policy.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of law.

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof shall be subject to the exclusive jurisdiction of the competent courts located in Kolkata, West Bengal, India.

12. Changes to Terms & Contact Information

We reserve the right to revise these Terms from time to time. When material changes are made, we will update the "Last Updated" date and notify active creators. Continued use of the Service after any modification constitutes acceptance of the revised Terms.
